How Do Some Unauthorized Immigrants in The U.S. Have Protection from Deportation?

Immig7

More so than any other country around the globe, the United States has the most immigrants wanting to come and live in the country. In fact, the United States is home to as much as one-fifth of the international migrants that come from almost every country around the world. There are several motivations for leaving one’s home country and coming to the United States. Regardless of the personal reasons for doing so, the Pew Research Center indicates that as of 2023, there were 47.8 million foreign-born individuals residing in the U.S. This is an increase of 1.6 million people from the year prior and marks the largest increase in immigrants in any year since 2000.

You may have your own reasons for wanting to travel to the U.S. However,  if you are unsure how to do so in the most effective and least stressful way, you don’t have to figure out the complex U.S. immigration system alone. It is your right to work with an attorney who understands U.S. immigration law to get the help you need to make the trip and be successful.

In Georgia, the Atlanta immigration attorneys at Shirazi Immigration Law, Inc. know how challenging it can be to work through the immigration system in the United States alone. The laws are always changing, the rules are complicated, and it is not uncommon for immigrants to be confused. When you have an experienced attorney on your side, you will have compassionate and knowledgeable legal counsel and representation to help you every step of the way, you will never be left out in the cold and on your own.

Unauthorized Immigrants who Have Temporary Legal Protections

You may have heard of unauthorized immigrants coming to the United States and having to live in the shadows in fear of deportation. You also may have been told that some unauthorized immigrants are in the United States and benefiting from temporary legal protections allowing them to actually lawfully work and live in the country without trepidation. It would be completely understandable to wonder why this is and how some immigrants have protections while others do not.

Several groups have a status in the United States where they are unauthorized but have temporary legal protection from deportation and, therefore, can live in peace knowing they are safe. This is how:

  • Temporary Protected Status (TPS) is offered to immigrants who had to flee their home country because it was unsafe due to civil unrest, violence, natural disaster, or another temporary but dangerous condition.
  • Deferred Action for Childhood Arrivals Program (DACA) does not provide a path to citizenship but does shield immigrants from being deported if they are not engaged in criminal activity.
  • Asylum applicants are able to stay in the country until their claims are adjudicated when their home country is hostile, and they are at risk of harm.
  • Through other special visas that apply to individuals who are victims of various criminal activities.
