Board of Immigration Appeals (BIA) Cases in Chattanooga
When an Immigration Judge or a USCIS or DHS official has ruled against you, it may be possible to appeal to a higher body or court. As the U.S. Department of Justice explains, the BIA is “the highest administrative body for interpreting and applying immigration laws.” The BIA has nationwide jurisdiction in the United States, and it has the ability to hear appeals in certain cases decided by an Immigration Judge or by a DHS district director. A decision made by the BIA will be binding unless it is overturned by a federal court upon further appeal. Most types of cases heard by the BIA include the following, according to the DOJ:
- Orders of removal;
- Applications for relief from removal;
- Exclusion of aliens applying for admission to the United States;
- Petitions to classify the status of alien relatives for the issuance of preference immigrant visas;
- Fines imposed upon carriers for the violation of immigration laws; and/or
- Motions for reopening and reconsideration of decisions previously rendered.
While parties currently residing or working in Chattanooga may be able to appeal to the BIA, it is important to know that the BIA is headquartered in Falls Church, Virginia, and most appeals are considered without oral arguments from the parties. In some cases, however, you may need to appear at the BIA headquarters for your appeal.
