Immig6

There are several benefits to investing in the United States, which is why many people from all over the globe have an interest in doing so. The E-2 Treaty Investor may be how you can meet your objectives and goals in the U.S. There is a caveat to obtaining a U.S. E-2 Treaty visa, though. You must be a citizen of one of the countries that have entered into the treaty to access it. The good news is there are over 80 countries that have, so depending on where you are from, you may be in luck. Although, out of the many countries that have entered into the treaty, two large countries, China and India, have not.

The Atlanta immigration attorneys at Shirazi Immigration Law, Inc. can speak with you and go over your financial goals within the U.S. When you need assistance and legal advice on how you can do business in the USA, then one of our experienced immigration attorneys is here to help you.

Obtaining an E-2 Visa

If you can obtain an E-2 visa, you will have up to five years to live and work in the U.S. Sometimes, an E-2 visa can even be renewed with no end date.

If you are eligible and you would like to start a new business, take over and run an existing business, or purchase a business, an E-2 visa allows for all of these actions.

Some requirements for an E-2 visa include:

  • The business that a foreigner wants to operate must be formed in the country, and the same nationality of the visa applicant must also be the nationality of the entity formed.
  • The investment required must be enough to fund the business and keep it operational.
  • To ensure the money being invested is legitimate and not laundered or gained through illegal means, it must be documented comprehensively and disclosed.
  • A significant portion of the investment must be spent to minimize the chances that the investment will be taken by a visa holder after they get their visa.

Other considerations for the E-2 visa are the business that a foreigner invests in must be active and operational. In other words, it must show that it functions as intended. It also must demonstrate that it positively impacts the U.S. economy. This could be by providing employment opportunities. The E-2 visa applicant must be using the visa to come to the U.S. to actually work at the business in an essential position that manages the investment.

An E-2 visa gives you nonimmigrant status. If you are married, though, it also provides a way for your spouse to come with you to the U.S. to legally live and work. This would be through an E-2S visa, where spouses would be applying as dependents.
